The NDIS Quality and Safeguards Commission has issued a statement in response to the Boland Report on Irabina. In it, the QSC apologises to the children and families harmed and confirms it is actively investigating Irabina “with a view to determining what further regulatory action should be taken against the provider and its former key personnel”. Statement from the NDIS Quality and Safeguards in response to The Boland Review Report on Irabina: “The NDIS Commission accepts the findings of the Independent Report and acknowledges that its handling of matters has not always met community expectations. Its immature system, processes and under-resourcing during its establishment years led to a fragmented approach to regulating providers that adversely impacted people with disability, their families and their carers who accessed NDIS funded services through Irabina from 2019-2022. The practices at Irabina, particularly within the Severe Behaviour Support Program, constituted breaches of the NDIS Act and associated Rules. The NDIS Commission recognises the harm experienced as a result of Irabina’s use of prohibited restrictive practices and restrictive practices. We apologise to people with disability, their families and their carers who accessed Irabina’s behaviour support services during this period for the systemic factors that – despite the best efforts of individual NDIS Commission staff at the time – let people with disability down. The NDIS Commission is actively investigating Irabina, with a view to determining what further regulatory action should be taken against the provider and its former key personnel”. It kind of sounds like the ndis is referring to this as an incident in the past, and are not acknowledging that the system that was in place then that allowed these failures to happen still exists. It hasn’t changed. We are kidding ourselves to think this was only an Irabina issue. There are others. The safeguards are not safeguarding… yes there are capacity issues when starting something new but the roll out has been mostly a debacle because we are failing it set a clear standard for the knowledge experience and values required to provide effective safe behaviour support.
Dr. Chan's discrete settlement with the Commission and the arrangement for him to work from home, following the closure of the federal court case, indicate an attempt to resolve the matter quietly. While such a settlement may address the legal aspects of Chan's suspension, it does not necessarily contribute to a broader resolution of the systemic issues or transparency within the Commission. The most concerning aspect of this situation is the absence of redress or support for the individuals directly affected by the practices at Irabina Autism Services. The failure to provide compensation, support, or justice to the victims underscores a significant gap in the Commission's protective and regulatory framework. It highlights the need for mechanisms that ensure affected individuals receive the redress they deserve.
The dissemination of misleading information to the media by Tracy Mackey contributes to a serious breach of trust & raises questions about transparency & integrity within the NDIS Commission. This action undermines public confidence in the Commission's leadership and its commitment to accountability. Then her sudden departure days before the report is released. The situation with Dr. Jeffrey Chan, where he was ostensibly made a scapegoat for the Commission's shortcomings in addressing the misconduct at Irabina Autism Services, highlights significant issues of fairness and internal accountability. The decision to suspend Chan, despite his limited oversight responsibilities, suggests a failure to appropriately address & distribute responsibility for the oversight failures. The fact that significant problems at Irabina Autism Services were allowed to persist for 4 YEARS without decisive action by the NDIS Commission points to substantial lapses in regulatory oversight and effectiveness. This delay in responding to known issues jeopardizes the welfare of service participants and contravenes the fundamental objectives of the NDIS. They didn't act until AFTER the 4 Corners Report.
That report I'd so far from the true story it almost unrecognisable from the reality of the matter. "Overview" of the ACTUAL report. So deceiving. Shame on the QSGC

(slap on the Wrist.) -Tracy Mackey resigns prior to damning is report released. -Dr Chan - settles outside federal court with the commission for being scapegoated -CEO and daughter get a banning order (not until Dec 23) -Therapists who perpetrated the abuse that was deemed to be in breach of human rights ARE STILL PRACTICING AMD HAVE NOT BEEN INVESTIGATED -The victims and families are left with NO REDRESS, NO JUSTICE, NO ANSWERS, NO CLOSURE, NO PAYOUT FOR PAIN AND SUFFERING. Not even an apology. ARE YOU KIDDING ME. and the Safety Guards Commission claims to protect participants.
