The authors discuss the model of an anelastic evolution law of a defective continuum suggested in the article [M. Epstein and M. Elżanowski, J. Elasticity, 70, No. 1–3, 255–265 (2003; Zbl 1080.74015)]. Rewriting the thermodynamic residual inequality in terms of the divergence of Eshelby stress allows to derive the consequence of Clausius-Duhem inequality for the selection of admissible processes
