- I notice that the file is tagged both as PD and under GNU-FDL, which it can't be both. It looks like it was signed "Defoe, F", which is the same last name but different initial of the subject in the photo, which raises concerns about the ownership of the photo. A relative, maybe? - It looks like it was uploaded as PD but with wrong template, which triggered the bot to mark a warning about needing a rationale for each use, which the uploader attempted. - Full photos of nothing but the art, or any photo that could take away the copyright owner's ability to exclusively profit from their work would qualify, but since it is a photo with context of the art showing the location as well, I would disagree that it is a violation of the intent of the law. - I updated to a newer photo which was taken at a different location. I just forgot to update the location information. If you look back at the versions of the photo you'll see what I mean. I could not figure out how to delete the photo when I wanted to use a better quality one. So I uploaded a new one on top of the old one that was taken at a different place & time.

- I believe US government photos have metadata showing they are official-type photos. For example, [File:GEN Carter F.Ham 2011.jpg] shows that Monica King took the photo and its' source is an official website. This image does not have such data. So, if the photo was taken by a private individual, even if a government employee at the time, then that individual must release the photo. I'm not to sure if this is the place to discuss this, so please point me to the right place if I'm wrong. The photo was not taken in Belgium, but in France at the Père Lachaise cemetery. I made the photo myself. France also does not seem to have "panorama freedom" but I find other pictures of graves on the wikipedia article on Père Lachaise and do not understand why this one would have to be deleted (and not the others). Could you enlighten me? From what I understood it is illegal to post any picture of a Belgian or French landscape on wikipedia? The entry for panorama freedom mentions something on "incidental inclusion" as an exception but does not explain this. --wintermute314 (talk) 10:45, 17 December 2011 (UTC)[reply]
- I assumed Belgium as it says "Made by Bart Van den Bosch, Belgium on April 22, 2006" on the file page. Both France and Belgium do not have FoP - some more info can be seen at commons:COM:FOP. Copyright protection expires 70 years after the death of the original author, so old graves are OK (looks like most of those on the page are >70 years old - unlikly to know the creator, so the date of construction has to do), but this one is dated 4th May 1978 - Only 33 years ago.
