Incorrect PD Netherlands (government works)

From the licence template : In principle all works communicated to the public by or on behalf of the public authorities (government) are not copyright protected in the Netherlands, unless the copyright has been reserved explicitly, either in a general manner by law, decree or ordinance, or in a specific case by a notice on the work itself or at the communication to the public. The rights are reserved at http://www.defensie.nl/servicemenu/help/ : Het auteursrecht op de website wordt door het ministerie van Defensie voorbehouden. Onder voorwaarde dat de bron vermeld wordt, mogen onderdelen van de inhoud van de website worden overgenomen. So the licence is incorrect. Multichill (talk) 13:28, 6 March 2009 (UTC)
- Delete, some of this images was already marked as no permission, like File:Jack de Vries Defense.jpg, the uploader removed the no permission template and put the reason for deletion, the terms of use in http://www.defensie.nl/servicemenu/help/, as permission. He accused me to not read the laws, which was wrong, and oneself he not read the easiest informations. The images are nonfree, so delete. --Martin H. (talk) 13:49, 6 March 2009 (UTC)

- Delete, I've also (mistakenly) removed the no permission template on some of those because I thought {{PD-NL-Gov}} applied, but in light of the above quote, it is clear that it doesn't. By the way, it's a shame that the {{No permission}} template doesn't include a reason= argument (like the {{Copyvio}} template does), because in some cases it is not obvious why permission is required. --Tryphon (talk) 14:53, 6 March 2009 (UTC)

- Comment The PD may refer to old mailcontact between a user from wikipedia-nl to the ministry of defence, see nl:Overleg_help:Gebruik_van_openbare_bronnen#www.mindef.nl. Ciell (talk) 13:28, 8 March 2009 (UTC)

- The permission is realy old (Dec. 2002) and not stored in OTRS, also the website is totaly restructured. The Nov. 2002 version of the website also contains a copyright notice, so we can be hopeful that permission is given again, but i would not extend an permission of something old to something new. - Comment got a response: De afbeeldingen die te vinden zijn op www.defensie.nl mogen helaas niet gebruikt worden voor commerciële doeleinden. Hierbij wil ik u dan ook laten weten dat wij geen afbeeldingen willen vrijgeven aan Wikimedia Commons. (commercial usage is not allowed). Multichill (talk) 20:40, 23 March 2009 (UTC)
