Terms of use of the US Holocaust Memorial Museum state that the copyright content is only available as fair-use. This particular image is marked as copyright, not public domain, and should therefore not be on the Commons. Diannaa (talk) 00:55, 25 June 2012 (UTC)[reply]

It is an attemp to correct File:Destinations from Madrid-Chamartín Station.svg, it should have been uploaded as a new version of that file, not as a new file.

File had been tagged for missing source already on May 13. However, the uploader has removed the tag without providing the required information. Actually, the uploaders statement in a discussion with the no-source-tagger[1] suggests that the images in this collage have been copied from somewhere ("we didn't know from where"). I don't know whether this diagram was also taken from the book, but it looks like a scan and the only other files uploaded by this user were deleted as copyright violations (File:Clamp jigs.jpg and File:Box jigs.jpg). Kept: The copyright would have required renewal in 1982. Renewals after 1978 are searchable on line and this isn't there.

For anything created 1950-1963, such a search is easy at http://www.copyright.gov/records/ and would be much appreciated by the closing Admin. Before 1950, it would be a manual search for the renewal, very tedious. After 1963, renewal was not required.

This sign is in Italy. In most countries, all paintings, sculpture, architecture, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately the FOP exception does not apply in this case.

Yes, I don't doubt it. However the music seems not be recorded in the year 1906, it is done definitely later (listen to it) and as you say no source is given. So it maybe be a case of license washing via archive.org. I think the best way to solve this issue is to remove this audio part. It is very unlikely that this 1944 work is PD. If this is the first publication, it may be under copyright for many years. In order to determine its status, we will need to know if it was published before.

If, as the file description suggests, the upload to Commons is its first publication and the photographer is unknown, then it will be copyrighted in the USA until 2064 -- 120 years after its 1944 creation. Again. Please learn the rules under which we all must work. A 1944 photograph is almost certainly not Public Domain. The copyright belongs to the photographer or his heirs. You may own a copy of the photograph, but you almost certainly do not own the copyright to this professional photo.
And, as I said above, according to you, which you confirm above, this is the first place it has been published. That means that it has a USA copyright for 120 years from creation or 70 years from the death of the photographer, who you have said is unknown.

  • {{PD-because}} does not apply because neither the fact that he was a Rear Admiral nor the fact that his grandson gave you a copy of the image nor the fact that you wrote an article on the man has anything to do with the problem.
  • {{PD-heirs}} does not apply because we have no evidence to support it. This looks like a professional photograph to me, but it does not matter. Unless you can prove who took the photograph and that the photographer's heir has released it, we cannot keep it here.   • Exactly, this photo could be done in a home studio, but in this case we have to know the name of the photographer. This will be a proof. В общественное достояние мне передал лично правнук этого контр-адмирала СССР (изображённый на фотографии его прадед с прабабкой и дед молодой курсант), о чём я сохранил переписку с ним (где он прикрепил фото и генеалогию указывающую на степень его родства). Это фото из его домашнего альбома в СПБ (Россия), они граждане Российской Федерации. Предназначено для иллюстрации публикации о его прадедушке в Русской Википедии. Он даже его вывесил в социальной сети "Одноклассники-РУ" в его личном профиле. Имя фотографа семья правнука не знает как сообщить мне для вас (так как его дед, прабабушка, прадедушка - изображённые на данном фото уже нет в живых), так как это было после введения новой униформы в 1943 году в СССР, по случаю чего было сделано фото; и на фотоаппарате был использован технический приём - взвод съёмки на шнурке (30 см длинной) с последующей съёмкой кадра через 30 секунд (само- фотографирование), фотоаппарат на штативе в домашних условиях (на фоне тканевой шторы на стене). Фотография это настолько старая, что для публикации статьи о его прадеде его правнук не смог найти никакую другую сохранившуюся фотографию! Правнук его (передавший это фото мне в общественное достояние) не маленький мальчик по возрасту, а офицер мор.флота России - фото сделано давно (это фото единственное сохранившееся - он обещал искать ещё у родственников).         • Нет не противоречу. Я не знаю как это у вас называется, но я дал описание процесса. А кто нажимал на кнопку фотоаппарата на штативе - никто не помнит в семье правнука. Это прадед или дед.             • Даже у меня дома в личном семейном альбоме есть фото с моей юности в СССР, которые я делал сам и не смогу вам доказать ваш абсурд (фотоаппарат "Зенит" - далее с полифным покрытием чёрно-белая плёнка 36 мм в увеличительной колбе "Ракета" - на фотобумагу наносится проявитель ватой по середине под светом красной лампы - ложиться фотобумага в кювет с фиксажем - при дневном свете в электросушилку, обрезка резаком). This file was initially tagged by RadioFan as Copyvio (copyvio) and the most recent rationale was: image claims copyright by EUMETSAT, while this was displayed on a NASA web page, NASA did not create the image

Speedy Deletion

If you look at the copyright information at the bottom of the source page, it says 'NASA images and animation by Robert Simmon, using data ©2010 EUMETSAT.' I took that to mean that the animation was created by NASA (Robert Simmon) using DATA which was copyrighted, i.e. the data is copyrighted, not the animation produced from the data.
