- La Willem C. Vis Internacional Commercial Arbitration Moot o Vis Moot és una competició internacional de judici simulat. Des de la seva creació, l'any 1994, la competició s'ha celebrat anualment a Viena, Àustria atraient a més de 300 universitats o facultats de dret d'arreu del món. Aquesta és la competició més gran del món en l'àmbit de l'arbitratge comercial internacional, i és considerada una de les grand slam o moots principals. Actualment, també s'organitza la Willem C. Vis (Est) Moot. Aquesta segona competició, celebrada anualment a Hong Kong, és considerada la germana de l'edició de Viena. Va ser creada l'any 2003 i atreu el voltant 150 equips cada any, fent-la la segona competició de judici simulat en l'àmbit de l'arbitratge comercial internacional més important del món i és també considerada una de les grand slams. Les dues competicions utilitzen el mateix cas cada any. L'objectiu d'ambdues Vis Moots és fomentar l'estudi en l'àmbit de l'arbitratge comercial internacional, i animar la resolució de disputes entre companyies a través de l'arbitratge. El judici simulat se centra cada any en un cas diferent i sempre està basat en una transacció de venda internacional sotmesa a la Convenció de Nacions Unides en Contractes per la Venda Internacional de Béns (CNUCVIB). El cas també compta amb problemes processals sobre la jurisdicció o poders d'un tribunal d'arbitratge. La competició consisteix en una part escrita on els concursants han d'entregar una memorada en representació del demandant i una altra en representació del demandat uns mesos abans de la part oral, tot i que els arguments escrits no compten en la fase oral. - Der Willem C. Vis International Commercial Arbitration Moot oder kurz Vis Moot ist ein internationaler Moot Court, bei dem handelsrechtliche Fälle vor einem Schiedsgericht simuliert werden. Der Vis Moot wurde erstmals 1994 in Wien ausgetragen. Er ist nach Willem Cornelis Vis (1924–1993) benannt, der seinerzeit ein renommierter Experte für internationale Handelsstreitigkeiten und Schiedsverfahren war. Inzwischen nehmen rund 250 Teams aus mehr als 60 Staaten teil. Seit 2003 gibt es eine Schwesterveranstaltung in Hongkong mit dem jeweils gleichen Sachverhalt, weshalb viele Teams an beiden Veranstaltungen nacheinander teilnehmen. Von den Teams treten jeweils zwei Teilnehmer für den Kläger oder den Beklagten auf, verfassen einsprechende Schriftsätze und verhandeln vor einem dreiköpfigen Schiedsgericht, das aus renommierten Schiedsrichtern, Professoren und Anwälten besteht. Schriftsätze und mündliches Plädoyer werden separat voneinander bewertet und ausschließlich in englischer Sprache verfasst. Nach Einsenden der Schriftsätze nehmen die einzelnen Teams in der Regel an vielen Vorbereitungsveranstaltungen teil, wo sie auch bereits gegen Teams anderer Universitäten antreten. Inzwischen ist der Vis Moot der weltgrößte und renommierteste zivilrechtliche Moot Court. In den vergangenen Jahren hat sich die Vorbereitung vieler Teams deutlich professionalisiert, was dadurch ermöglicht wird, dass Wirtschaftskanzleien und Unternehmen die Teams finanziell unterstützen. - The Willem C. Vis International Commercial Arbitration Moot or Vis Moot is an international moot competition. Since 1994, it has been held annually in Vienna, Austria, attracting more than 300 law schools from all around the world and spurring the creation of more than 20 pre-moots each year before the actual rounds are held in Vienna. It is the largest arbitration moot competition, and second-largest moot overall, in the world; considered a grand slam or major moot. A sister moot, known as the Willem C. Vis (East) Moot, is held in Hong Kong just before the rounds in Vienna. It was established in 2003 and attracts around 150 teams every year, making it the second largest commercial arbitration moot and also a grand slam moot. It uses the same moot problem as the Vis Moot, as does the various pre-moot friendlies. The objective of both Vis moots is to foster study in the area of international commercial arbitration and encourage the resolution of business disputes by arbitration. The problem for the moot is always based on an international sales transaction subjected to the United Nations Convention on Contracts for the International Sale of Goods (referred to commonly as the CISG) and also involves procedural issues of arbitration such as jurisdiction and powers of an arbitral tribunal. The moot consists of submitting written memoranda for both claimant and respondent before the oral phase of the competition, though the written arguments have no bearing on either the preliminary rounds or knockout stages in the oral phase.
