According to news reports, the government has completed the draft rules for the Digital Personal Data Protection (DPDP) Act 2023 and plans to release them for public consultation in mid to late August. The final rules are expected to be notified after the current parliamentary session ends. According to officials, these rules will adhere to the framework established by Parliament, ensuring robust privacy protection while preventing frivolous complaints.
One unresolved issue is the verification of age and parental consent. The government has engaged with experts and industry stakeholders, who have provided various solutions. The IT ministry held extensive consultations on July 19 with representatives from social media and internet companies to discuss potential solutions for age-gating and parental consent.
Under the DPDP Act 2023, all users below the age of 18 are considered children and must obtain verifiable parental consent to use social media and other services provided by internet intermediaries. This provision is designed to protect the privacy and safety of minors online.
