The next thing that TRAI is focusing on is how to have growth across all verticals of the M&E sector. The regulator will also work on making the regulatory climate and the policy environment more business-friendly and promote ease of doing business so that the sector grows. 📢 On June 3, 2024, the Ministry of Information and Broadcasting (“MIB”) has introduced a new directive to submit a ‘Self-Declaration Certificate’ before publishing or broadcasting any advertisement on the Broadcast Seva Portal of the MIB for TV and Radio Advertisements & on Press Council of India’s portal for print and digital/internet advertisements. 🔖 All new advertisements from June 18, 2024 must have this certification, with a two-week buffer period for all stakeholders to adapt. 📝 Under the new directive, a self- certificate shall be signed by an authorized representative of the advertiser and/or advertising agency which shall be required to be submitted on the seva portal. 📌 The self-declaration certificate is to certify that the advertisement: (i) does not contain misleading claims, and (ii) complies with all relevant regulatory guidelines, including those stipulated in Rule 7 of the Cable Television Networks Rules, 1994 and the Norms of Journalistic Conduct of Press Council of India. 🔔 Further, the advertiser must provide proof of uploading the Self-Declaration Certificate to the relevant broadcaster, printer, publisher, or electronic media platform for their records. 📍 NOTE: As per the directive, no advertisement will be permitted to run on television, print media, or the internet without a valid Self-Declaration Certificate. #law #advertising #indiancomapnies #regulatory #legalupdates #advertiser #startups #MIB #misleadingads #transparency #consumerprotection #advertisingindustry

As an attendee of the IIC/Media Foundation Media Dialogue on December 5, 2023, I had the chance to witness a vital discussion on the draft Broadcasting Services Regulation Bill 2023. With the Ministry of Information and Broadcasting opening the bill for public consultation until December 9, 2023, this session provided a crucial platform to explore its implications. The bill aims to regulate all broadcasting entities—radio, television, OTT platforms, and digital news portals—under one framework. This led to the central question: Is this about fostering accountability, or could it lead to greater control over the media? The discussion, featuring panelists Barkha Dutt (Editor, Mojo Story), Jawhar Sircar (MP and former CEO, Prasar Bharati), Seema Chishti (Editor, The Wire), Abhishek Malhotra (Partner, TMT Law Practice), and Nikhil Pahwa (Founder, MediaNama), and moderated by Vibodh Parthasarathi of Jamia Millia Islamia University, offered diverse perspectives on whether the proposed regulations would support or hinder freedom of expression and operational flexibility for digital platforms. Being part of this dialogue underscored the importance of careful consideration as we approach the consultation deadline. Some very interesting points here...
I strive to maintain fairness when commenting on the SABC, its competitors, suppliers, and the Department of Communications and Digital Technologies (as shareholder and policy maker). Given my previous board role at the SABC, I often extend the benefit of the doubt to my former colleagues, as I am no longer privy to the strategic discussions influencing key decisions. While my critiques are sometimes sharp, they focus strictly on policy, never on individuals. In this context, the SABC's recent decision to explore an additional (or alternative?) satellite provider is perplexing. Here are some questions and points for consideration: 1. Why is SABC considering its own satellite service now, when its channels are already available in all MultiChoice Group and #OpenView homes, and the satellite distribution market is highly competitive? This move seems like a classic case of entering a 'red ocean' (a saturated, competitive market) rather than a 'blue ocean' (a market with more opportunities). I might have supported this initiative a decade ago, but at that time both Sentech and the government were strongly opposed to anything that could potentially rival their DTT platform. 2. The reported requirements of the tender document seem to be advantageous for a single supplier, namely SENTECH Soc Ltd. Given that the SABC is currently embroiled in a tariff dispute with Sentech and already owes the state-owned signal distributor over a billion rand, wouldn't entering into another contract with the same company exacerbate the existing problem? 3. How long will it take for the SABC (and its prospective partner) to roll out set-top boxes in households, considering that it took OpenView many years to reach over 3 million homes? Given this lengthy process, how can this initiative be a viable response to the imminent switch-off of the analogue transmitter network? 4. Why is SABC looking for a revenue share with the successful tenderer when it currently retains all the advertising revenue under its agreement with OpenView? 5. What does this decision imply about the failed rollout of the DTT platform? Has the government and Sentech now conceded that DTT is a failure? Furthermore, will they disclose how much taxpayer money has been spent on this unsuccessful endeavour? 6. Will former Ministers of Communication, excluding Mondli Gungubele who was consistently fair, now acknowledge that the previous board's concerns about DTT were valid? Furthermore, will they admit that their harsh public criticism of the previous board was unjustified and unwarranted? 7. Lastly, if the SABC aims to "control its own destiny," shouldn't it focus all available resources on creating compelling content, making its unique archival content accessible, and transforming #SABCPlus into the most successful free streaming app on the African continent? SABC Plus is the SABC's own platform and does not rely on Sentech for distribution.
