The entrant shall have the right of authorship, and the copyright of the work shall remain that of the entrant.
By entering, participants warrant and represent the following: (a) each participant is the sole and exclusive owner of the submission; (b) participants’ submissions will not infringe on any rights of any proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (c) any third parties appearing in the submissions have given participants appropriate consent to be photographed and used as permitted herein; (d) submissions shall not violate any applicable laws.
All entrants shall be deemed to agree with this clause. All legal responsibilities for any disputes arising from the above guarantee shall be borne by the entrant himself/herself and shall have nothing to do with the participating platform and the contest organizer.
By entering the competition, the entrant agrees and authorizes the organizer to use the submitted entries for promotional activities related to the competition without any compensation, including but not limited to using the entries in online media, print media, print, photography exhibitions, retail stores, road shows, and other activities, etc. There is no geographical limit on the scope of use. The organizer is also authorized to modify and crop the photos. The organizer is not required to notify the entrant or obtain the entrant’s consent to use the entry. The organizer includes Guangdong OPPO Mobile Telecommunications Corp. Ltd., and its affiliated companies, strategic partners, etc.
The winning participants provide an irrevocable and free authorization to the organizers and their affiliates, partners, and submission platforms to exercise the global intellectual property rights of the award-winning photographs (including all elements of the photographs such as character portraits, etc.), including but not limited to the Right of Dissemination via Information Network, Right of Reproduction, Right of Alteration, Right of Adaptation, Right of Compilation, and other copyrights for commercial and non-commercial purposes from the date of the announcement of the competition, non-exclusively. The authorization period is one year from the date of announcement of the winners. Furthermore, the organizers and their affiliates, partners, and submission platforms are given the authority to repost, reproduce, adapt, compile, exhibit, distribute, print, display, publish, and create derivative works of the award-winning photographs for commercial and non-commercial purposes, as well as to add corporate logos, commercial identifiers, and other necessary promotional features to the award-winning photographs to promote and advertise the competition. Upon expiration of the authorization period, the organizers, their affiliates, partners, and submission platforms are not required to remove or delete any promotional materials based on the use of the award-winning photographs under these provisions.
