The Canadian government will provide thousands of dollars in alcohol excise duty relief to craft breweries. While we’re happy for craft brewers, the cannabis industry has been asking for similar relief for years. The Canadian government cited the number of jobs created by the brewing industry and the contribution it makes to the broader economy, but the cannabis industry’s contribution shouldn’t be ignored. For comparison: In the 2022-23 fiscal year ended March 31, the Canadian federal government received $610.1 million from excise duties applied to beer. Federal excise duties from cannabis that same year, meanwhile, amounted to approximately $894.6 million. According to Statistics Canada, in 2022, breweries employed nearly 23,000 Canadians. A Deloitte Report from 2021 said the cannabis industry employed more than 43,000 direct and another 180,000+ indirect jobs in its first three years. In 2018, the Conference Board of Canada reported that the beer industry supported 149,000 Canadian jobs, paid $5.3 billion in wages, and contributed $13.6 billion to Canada’s GDP in 2016. A Deloitte Report from 2021 said the Canadian cannabis industry contributed $45.5 billion to Canada’s GDP in its first three years, or an average of about $15 billion a year. The Canadian #cannabis industry is facing significant financial challenges, as detailed in a recent briefing to the Finance Minister. Key issues include escalating excise-tax debts, and the lack of sustainable profits for private-sector cannabis companies, in contrast to record profits for government-owned wholesalers. Additionally, a growing number of cannabis producers are entering creditor protection. Given these difficulties, SR&ED tax credits could present a resource opportunity. These credits allow companies to offset eligible expenses associated with innovative projects and research. I still have patients say to me in the Emergency Department, after they’ve waited 5 hrs to be seen, and been brought to hospital by an ambulance and 2 paramedics, for chronic back pain, that their GP doesn’t believe in medicinal cannabis, so they’ve never had it discussed as a treatment option . As a Barrister I would advise all doctors- whatever your personal view is on cannabis, if you have not kept up with the research and science behind medicinal cannabis then you are being negligent in your duty of care in several ways: 1) Science denial will get you reported for being incompetent and uninformed. 2) Your duty of care mandates that you discuss all recognised treatment options with your patient. 3) the failure to inform your patients about a viable treatment option can be considered to be both negligent, and incompetent. 4) not understanding how cannabis interacts with human cannabinoid receptors, the human cytochrome P 450 system and the many other drugs that are routinely prescribed in general practice or specialist medicine is negligent if you are managing patients clinically. 5) Denying treatment to a patient is a viable cause of action for litigation.

The number of inspections of federally licensed cannabis facilities and licence holders in the 2023-2024 fiscal year was on par with the previous year, but targeted inspections increased notably. This number is on par with the 662 inspection activities in the previous year, 170 of which were of registered personal and designated production of cannabis for medical purposes inspections. Targeted inspections increased significantly from the previous year, from 18 to 101. A targeted inspection is conducted to assess specific issues at a licensed facility.  #cannabisindustry #cannabissales #cannabislegalization
